
The Bar Council of India (BCI) has issued a clarification regarding the entry of foreign lawyers and law firms into the Indian legal market. The BCI has stated that foreign lawyers and law firms are not allowed to practice Indian law or represent clients in Indian courts or tribunals, except on a “fly-in-fly-out” basis for providing legal advice to their clients on matters related to foreign law. The BCI also clarified that foreign lawyers and law firms cannot establish offices or employ Indian lawyers or legal professionals in India. Any violation of these rules could result in disciplinary action against the offending foreign law firm or lawyer. This clarification by the BCI is in line with the Advocates Act, 1961.
